Genova v. Carbone

Two of New Jerseys most prominent election law experts, Angelo Genova and John Carbone, will face off in a Morristown courtroom on January 8 to decide the November 2005 race for Mayor of Parsippany. Republican Rosemarie Agostini, who lost to Democrat Michael Luther by 39 votes, alleges that as many as 124 voters were either illegally turned away from the polls or voted improperly.

The expedited trial was scheduled after a state appellate panel overturned a Superior Court Judge's denial of Agostini's challenge. Genova, Luther's attorney, has asked the state Supreme Court to issue a stay of the appellate decision. Genova is challenging the constitutionality of a state law that permits elections to be challenged. In that effort, he will be opposed by state Attorney General Stuart Rabner.

Dana Wefer, Morris County candidate for Freeholder, said Wednesday that Morris County officials dodged and avoided all the important points regarding her study of how municipalities are represented on the county’s advisory boards. "The county basically said that Morristown may actually have fewer than 44 representatives because some of those addresses could be in Morris Plains, Hanover, the Township or Parsippany," Wefer said Wednesday. She added, "Yea, well, that's understood and obvious. The point is that none of those 44 actually come from Florham Park, which had zero representatives or Riverdale or Pequannock with had one and two respectively." Wefer’s point, she says, was that the Northeastern part of the county is sorely underrepresented. She points out that no matter how you move those numbers from those 5 towns surrounding the county seat around, none of them are going to end up on the Northeastern part of the county, which has only 11 representatives for 5 towns. DEMOCRATIC FREEHOLDER CANDIDATE WEFER TAKES ON MORRIS FREEHOLDERS ON THEIR TURF
Wefer Presents Resolution to Board Requiring Accountability in Capital Surplus Expenditures

Morristown, August 24, 2006- Dana Wefer, the 24 year old Democratic candidate for Morris County Freeholder took the Freeholders to task on their turf last night at the Freeholder meeting. Wefer has been sparring with the Freeholders for several weeks over what she has leveled are “lavish� and “wasteful� expenditures resulting from broad ordinances allocating money from the capital surplus fund for maintenance of county facilities.

The expenditure that prompted the original salvo being launched was $50,000 the county allocated from the capital surplus fund to be used to replace furniture in their conference room. The freeholders have not commented on the expenditure, but county administrator John Bonnani has maintained the though the resolution described the expenditure as being for conference room furniture, it actually was intended for other non-specified items as well.

That explanation resulted in last night’s proposed resolution, in which Wefer implored the Freeholder board to adopt a policy of listing in a line item fashion all expenditures exceeding $5,000 and all expenditures under and over $5,000 should the number of capital surplus expenditures under $5,000 exceed 20 in a single fiscal year. Wefer maintains that the resolution, if adopted, would result in tighter controls over where taxpayer money is allocated, would force the freeholders to determine whether the amount of money allocated for a particular project is reasonable and would empower Morris County citizens to determine whether the amount of money allocated for a particular project is reasonable.

DEMOCRATIC FREEHOLDER CANDIDATE WEFER CALLS ON FREEHOLDERS TO UPGRADE RESOLUTION STANDARDS

Morristown, 15, 2006- One day after condemning the Freeholders’ authorization of spending $50,000 for conference room furniture, Democratic Freeholder candidate Dana Wefer called on the Freeholder Board to set standards for specificity in their resolutions.

The text of the ordinance the Freeholders passed stated that $50,000 was to be allocated from the capital surplus fund to buy new furniture for their conference room. County Administrator John Bonanni said that it was actually for furniture at various county facilities and was just written broadly. This explanation is what prompted Wefer to call on the Freeholders to adopt standards that require more specificity in their resolution and allocation of money.
